✨Terms & Conditions ✨

What are they?: An artist's terms and conditions are a set of legal rules and guidelines, established in a contract, that define the artist's responsibilities and rights when offering their work or service, and also the client or contractor's responsibilities when receiving it. These terms protect both parties, clarifying aspects such as copyright, scope of work, payment terms, exclusivity, use of the artist's image, and how their work will be used.

✨ My Terms & Conditions ✨

1. The artist understands that when you request and pay for a commission, you have read, fully understood, agreed to, and are bound by the Terms & Conditions, as a client.2. Have a clear idea of what you wish to be commissioned for; be clear and detailed (The artist accepts that you share sketches, images,pose references and drawings for what you want to commission, as well as references of accessories that go with the work).
2a. If you wish to make changes, you can only request them during the drafting process. Once the draft is finished, only three changes can be made, each costing $0.50. This means you must be sure of exactly what you want and how you want it to look.
3. The artist does not comply with the terms mentioned in the "I Can't Draw" section, and no exceptions are made regardless of the amount of money you offer or the type of relationship the artist has with you. The artist maintains a Worker-Client relationship with you when commissioning.
3a. If the commission you wish to commission doesn't fall into either of the two categories ("I can draw" and "I can't draw"), you can ask the artist if it's possible. The artist may not have experience with that type of drawing or character, so you can make an Attempt (here, an Attempt is defined as a sketch, which is being done for free, where you can see a design of what the work could be. If you like it, you will pay for it at that time, and the complete work will be done).
4. Payment is made in full so that it is on hold or the commission is started. The artist does not issue refunds.5. You should make sure you have enough money to ask the artist for a commission, as paying commissions should be a luxury you can afford.
5a. If you are a minor, make sure your guardians agree to pay the commission and you must show proof of this to the artist. If they refuse, do not insist, do not steal, or use their money to obtain a commission. If the artist returns the money for this reason, you must wait until you are of legal age to request a commission, and you must prove that you are of legal age and/or that you have your own income.
6. The artist will not accept or tolerate any type of blackmail, defamation, or other actions that attempt to FALSELY discredit the artist. Therefore, the artist has the right to take screenshots of the conversations she has with you for her own protection..
6a. If you do this type of action, you will be banned (you will not be able to request commissions for life). And if that happens mid-commission, the artist will return half of the money and keep the other half (as compensation for damages). They'll also redesign the drawing, using yours as a base, and auction it off. You won't have any rights to the redesigned piece.
7. The artist will not tolerate her art being turned into NFTs, used for AI, or stolen by copying (violating copyright), so if the artist finds you with these intentions, she will ban you (as in point 6a). In case those actions have been carried out and the artist finds out, she has the right to make your intentions known to other artists using the collected evidence and ban you in the same way as in point 6a (the same mentioned in point 6a will also be done with the piece if those intentions are found in the middle of the commission).8. (Regarding not drawing characters from the LGBT community, noted in the 'I Can't Draw' section): I can draw the characters as long as I don't put any symbol, flag, or combination of representative colors of the collective in their appearance (clothing, accessories, hair color, skin, fur and background, flags, etc.), and I can draw them if they have an appearance according to their original gender (it is ♀️ or it is ♂️).
8a. I can draw couples as long as it is not in a romantic situation or sense, nor does it imply the status of their relationship.
9. If you have any questions about the T&Cs or anything that is not clear to you, you should consult with the artist.10. (Commercial Use): If the piece is to be used commercially, this must be made known to the artist, as the price will vary depending on the percentage of products sold. If the work is for a business, the percentage of the price will be 5% of the product sold. If it's for a company, the percentage of the price will be 15% of the product sold.
10a. If you wish to have permanent use of the piece for commercial purposes, the amount will be agreed upon by the Artist.
10b. The artist does not agree to use her OCs in commercial use commissions (You cannot commission the artist to use her OCs on your merchandise).
11. The artist has the right to use the piece she created for you for promotional purposes (stating that it was a commission).
11a. If you wish to keep the commission private, an additional $10 will be charged, but you must tag the artist if you post it on your social media.
